Re: Possession is 9/10ths
I'm not a lawyer either but have worked with enough ERP software to understand their licensing. If Rimini had just remoted into the customer hosted test database, they would have been fine. I can't imagine why they thought they could host using the customer's license.

That's got to be one of the more ignorant things I've ever heard a major company do. I'd love to hear the internal reason why they thought they could get away with that. Usually if someone hosts for you, they purchase the needed licenses and then "rent" to you. You can't just assign license rights like that from customer to hosting company.

Downloads damning?
Lorna, that's possibly right, but for me to reply in full, you'd have to pay me like a lawyer, which I am not.

Possession is 9/10ths
Seems like a mistake on Rimini's part to have initially hosted some instances in its own data center. However, if the software is in the data center of the company that purchased the licenses, it's hard to see how Oracle has a legal beef, right?

InformationWeek's IT Perception Survey seeks to quantify how IT thinks it's doing versus how the business really views IT's performance in delivering services - and, more important, powering innovation. Our results suggest IT leaders should worry less about whether they're getting enough resources and more about the relationships they have with business unit peers.
