I've been developing software for over 20 years. I regular pass code re-factoring and general project redesigns, but I don't change my APIs, because it is only part of my job which is persisted from version to version. So now you say that the crappy code I regularly dump is copyrightable, but my APIs I develop and spend majority of design time on them are not.
Are you insane there?

I suggest reading the decision from the Luxembourg court carefully. So far as I can tell, it does not really touch on the question about APIs as it appears in this case. But I am curious what others think. Here a link to the decision in English:
