Apple and Samsung will be suing the pants off each other for years. The products and technologies in dispute will have long since hit the dust bin by the time the case sees the inside of a court room.

Here's an idea. Instead of suing each other after the fact, why not gather up your patent portfolio and develop a rule book that says something to the effect "you can design and build any product you want... just don't violate any of the rules you see here in my book". It would clearly define the boundaries and mark the trail so that a competitor will have a harder time claiming that they didn't know about a patent.
