The difference between ""good"" and ""bad"" software, therefore, is determined by intent and behavior of those that develop and distribute the software, not interactive software technology itself. This paper explores publics understandable confusion surrounding spyware, describes applications of technology which are useful and beneficial as well as those that are problematic, even illegal; and discusses how attempts to legislate or regulate spyware could introduce very negative unintended consequences for other types of interactive software.
