Simple solution, STOP USING ORACLE. I stopped using their software 15 years ago, and am doing quite fine without them, thank you very much. There are plenty of other workable solutions out there, some are even free.

Great article. It is a very surprising ruling. The problem is that there is no practical way of enforcing this judgement, if it sticks, with any meaning. There is a big difference between creating a court ordered port and providing decent support and integration work. Does anyone think Oracle is going to put their all stars on the Itanium support team (or will it become a punishment assignment)? Are they going to be back in court every time Oracle is slow to create customer specific patch or fix? The court might be able to force Oracle to support Itanium, but I don't see how they can force them to do it well.

What does this mean for Microsoft and Red Hat? I am sure those companies issued press releases stating that they were committed to Itanium and HP, particularly Microsoft. I am sure HP sent them free test gear and "relied to their detriment" on their support. They were both able to drop Itanium several years ago without issue. You can see all sorts of new "contracts" which were not thought to be contracts, by either party, at the time coming out of this ruling.
